Last year, Apple paused the sales of itsApple Watch Series 9andApple Watch Ultra 2smartwatches in the US after an import ban came into effect following a complaint frommedical monitoring technologycompany Masimo. However, the iPhone maker convinced a US appeals court to pause the ban the next day and was reported to be working on a workaround to avoid a ban in the US.According to a report by news agency Reuters, Apple has found a way to bypass the import ban on its newer Apple Watch models.As per the latest development, the complainant Masimo in a court filing said that “US Customs and Border Protection decided that Apple’s redesign falls outside the scope of” the ITC ruling.Apple’s plans to avoid ban on Apple WatchApple’s redesign is to remove the pulse oximetry features from newly-sold devices. This feature is the backbone of the whole issue. Masimo alleged that Apple stole its pulse oximetry technology and hired its employees to develop the feature in its smartwatches.Apple, in turn, countersued Masimo for patent infringement, claiming that the legal actions were an attempt to eliminate competition. After contention, a ban was issued by the US International Trade Commission (ITC) and applied to Apple’s current Series 9 and Ultra 2 watches.Notably, the iPhone maker is removing this feature in the US market only. Apple has not publicly revealed the details of the proposed redesign that would allow it to avoid infringing on Masimo’s patents related to pulse oximetry technology.While the US court is still deliberating on whether to continue the pause or reinstate the ban, Apple is allowed to sell the Apple Watch models in question.
